Sphyrsync is an app for making short videos and photo posts and publishing them to the places you choose. It is run by Dreamform Studios, Mashpee, Massachusetts, USA ("we", "us"). These terms are the agreement between you and us when you use Sphyrsync. Please read them. If you don't agree, don't use Sphyrsync.

Sphyrsync is pre-release software. Right now it is invite-only, free, and runs on our own computer in our studio, with nightly backups to a second drive and an off-site copy. That means:
We do our best to keep it running and your data safe, but we can't promise it will always work or never lose anything.
You own the videos, photos, sound, captions and other things you put into Sphyrsync ("your content"). We don't own it and we don't use it for anything except running Sphyrsync for you.
To do what you ask, we need your permission to store, copy, edit, render, transcribe and send your content. You give us that permission, worldwide and without charge, only for:
We will not sell your content, use it in ads, use it to promote Sphyrsync without asking you first, or use it to train AI models. This permission ends when you delete the content or your account, except for copies in backups, which are overwritten over time (see the privacy notice), and copies already published to other platforms, which those platforms control.
You promise that you have the rights to everything you upload: the footage, the people in it who need to agree, and any music or other material in it.
When you connect Instagram, Facebook, YouTube, Telegram or another account, you authorise Sphyrsync to post there only when you tell it to (including posts you schedule). Each platform's own rules still apply to everything posted there. You are responsible for what you post. Platforms can change their rules, limit what apps like ours can do, or remove posts and accounts; we aren't responsible for their decisions. You can disconnect an account at any time.
For some platforms (for example TikTok), Sphyrsync hands the video and caption to the platform's own app, and you finish the post there.
Posts made on the free plan carry a small "◎ Sphyrsync·@yourhandle" mark. On PRO you can turn the mark off. People we invite as founding creators during the beta get PRO free for life.
Some features use AI services to help you: the Writer suggests captions, hashtags and a read of your opening, and auto-captions transcribe the speech in your video. The privacy notice says exactly what is sent and to whom. AI suggestions can be wrong. Read them before you post; what you post is yours to answer for.

Also don't try to break, overload, scrape or get around the limits or security of Sphyrsync, or use it to build a competing service.
You can report any post, comment or account in the app, and block anyone. A person reads every report. We don't promise a time for most reports; a report that a child could be at risk, or of intimate images shared without consent, hides the post while we look.
Every upload is checked against lists of known child sexual abuse images before it can be shown. A match is blocked, preserved as the law requires, and reported to NCMEC, and the account is held. Uploads are also checked for nudity by a model on our own computer; a post it flags waits for a person to review it, and goes out once approved. We don't otherwise scan or read your content.
To ask for removal of an intimate image of you shared without consent, use the takedown form. We remove it, and every copy of the same file, within 48 hours of a complete request.
We can hide posts, remove content, and suspend or close accounts that break these terms or put people at risk. Where it's sensible we'll tell you why.
You can delete your account at any time in the app (You › Delete account). That deletes your account and content as the privacy notice describes. We can suspend or close an account that breaks these terms, or close the beta. If we close the beta, we'll give at least 30 days' notice by email, except where the law or someone's safety requires otherwise, so you can download your data first.
Sphyrsync is free during the beta, and founding creators keep PRO free for life (section 5). If we start charging for PRO, we'll tell you the price before you're charged anything, and you'll choose whether to pay. Nobody is moved to a paid plan without saying yes.
Sphyrsync is provided "as is" and "as available". To the extent the law allows, we don't make warranties about it, including that it will meet your needs, be uninterrupted, or be error-free.
To the extent the law allows, we aren't liable for indirect or consequential losses (such as lost profits, lost followers, or lost data), and our total liability to you for anything related to Sphyrsync is limited to US$50 or the amount you've paid us in the past 12 months, whichever is more. Nothing in these terms limits liability that the law doesn't allow us to limit.
You agree to cover our reasonable costs if a claim is brought against us because of content you posted or your breach of these terms.
If we change these terms, we'll show you the new version in the app and ask you to agree before you keep using Sphyrsync. We keep a record of which version you agreed to and when.
These terms are governed by the laws of the Commonwealth of Massachusetts and the United States. Disputes go to the state or federal courts in Massachusetts, unless the law where you live gives you the right to bring them where you live.
